Actually these are orthoganal ideas. Let us say a couple of guys initially
cook up a neat idea. What they would do is first file a patent and then create
the draft.

If the person contributing these ideas has significant contributions there is
no reason why this person cannot approach the original folks to add him/her
self to the patent or just create a new one.
